Indonesia trademark decisions

It has been a busy week in the Central Jakarta Commercial Court for trademark cancellation disputes. 

  

Toyota is surely the most prolific IP litigant in Indonesia. One of its top selling cars is the Toyota Kijang Innova (left).  Another local company registered INNOVA for tires. The Central Jakarta Commercial Court on Thursday (27/10/2011) granted Toyota’s application to cancel that registration on the basis of similarity. The case was undefended and continues Toyota’s winning streak –  now 3-1 in 2011 - see here for more Toyota cases.

In another case local phama manufacturer PT Supra Ferbindo Farma makers of a range of OSKA prefixed drugs including Oskadon SP (left), Oskadryl, Oskamag, Oskasal, Oskamo, Oskavit sued an individual Widjajanti Rahardja. to cancel her Oskangin  trademark registered in class 5. PT Supra has used OSKA in brands since 1987 and OSKA is the dominant element which led to a similarity finding by the judges.
