The Justice Secretary Leila de Lima has just reversed the somewhat suspect resolution issued earlier by her undersecretary recommending the filing of charges against the Thai officers of Red Bull and their local distributors allegedly for unfair competition. The dispute revolved around the conflict between a regulatory approval to sell and IPRs.
De Lima said she found no probable cause to warrant the filing in court of the complaint of Energy Food and Drinks Inc. against T.C. Pharmaceutical Industries Co. Ltd. and its current authorized importer and distributor Maryland Distributors Inc.
What is most worrying is that minor officials can be persuaded to abuse their power to instigate criminal action in what was clearly a contractual grudge dispute and it took escalation to the top DoJ official to stop the case.
